1. Our services

Quantum Thinker provides cloud-based software subscriptions (including BOSS Cloud ERP), enterprise system customization, AI agent solutions and mobile application development services. Specific deliverables, service levels and pricing for subscriptions or projects are set out in the applicable order form, proposal or service agreement signed with you.

Information on this website is general in nature and does not constitute a binding offer. A contract is formed only when both parties sign an order form or agreement.

2. Accounts and acceptable use

You are responsible for keeping your account credentials confidential and for all activities under your account. You must provide accurate registration information and keep it up to date.

You must not misuse the services — including attempting unauthorised access, interfering with the platform's operation, uploading malicious code, or using the services for unlawful purposes. We may suspend access where we reasonably detect abuse or security risk.

3. Subscriptions and payment

Subscription fees are billed in advance according to your plan and billing cycle. Fees are exclusive of applicable taxes (including SST), which will be added where required by Malaysian law.

If payment is overdue, we may suspend the service after giving reasonable notice. Either party may terminate a subscription in accordance with the notice period stated in the service agreement.

4. Your data

You retain all rights to the data you upload to our services. You grant us the right to host, process and back up that data solely to provide and improve the services. Our handling of personal data is described in our Privacy & Data Protection Policy.

You are responsible for the lawfulness and accuracy of the data you upload, and for maintaining your own independent backups where appropriate.

5. Intellectual property

The website, the BOSS platform, our software, documentation and branding are owned by or licensed to Quantum Thinker and protected by intellectual property laws. Your subscription grants you a non-exclusive, non-transferable right to use the services during the subscription term.

Custom development deliverables are licensed or assigned as agreed in the relevant service agreement.

6. Service availability and changes

We aim to keep the services available 24/7, with planned maintenance announced in advance where practicable. We may update or improve features over time, provided such changes do not materially reduce the core functionality you subscribed for.

7. Limitation of liability

To the maximum extent permitted by law, Quantum Thinker is not liable for indirect or consequential losses, loss of profit, revenue or data arising from the use of the website or services. Our aggregate liability is limited to the fees you paid for the affected service in the twelve (12) months preceding the claim.

Nothing in these terms excludes liability that cannot be excluded under Malaysian law.

8. Governing law

These terms are governed by the laws of Malaysia. Any dispute will be subject to the exclusive jurisdiction of the courts of Malaysia, unless otherwise agreed in a service agreement.
